1. Agreement to Terms

These Terms of Service ("Terms") govern your use of the online ordering platform operated by Le Celebration Patisserie & Cafe ("we", "our", "us") at lecelebration.com and related services (collectively, the "Platform").

By placing an order or creating an account, you agree to be bound by these Terms. If you do not agree, do not use the Platform.

2. Eligibility

You must be at least 18 years old or have parental/guardian consent to use the Platform and place orders. By using the Platform, you represent that you meet this requirement.

3. Orders & Payments

3.1 Order Placement

• All orders are subject to acceptance and availability
• We reserve the right to refuse or cancel any order at our discretion
• Order confirmation is sent after successful payment processing
• Prices displayed are in Indian Rupees (INR) and inclusive of applicable GST unless stated otherwise

3.2 Payment

• Payment must be completed at the time of ordering
• We accept payments via approved payment gateways (UPI, cards, net banking)
• We do not store your payment card details on our servers
• Payment processing is handled by PCI-DSS compliant third-party processors

3.3 Pricing

• Prices are subject to change without prior notice
• Delivery charges, if applicable, are displayed at checkout before payment
• Promotional offers are subject to their specific terms and may be withdrawn at any time

4. Delivery

• Delivery is available within our serviceable areas (specific pin codes in Bangalore)
• Delivery time slots are indicative; we strive to deliver within the selected window but cannot guarantee exact timing
• You must provide accurate delivery address and contact details
• If delivery fails due to incorrect information or unavailability of the recipient, re-delivery charges may apply
• Risk of damage transfers to you upon delivery; please inspect items at the time of receipt

5. Cancellation & Refunds

5.1 Cancellation by Customer

• Orders may be cancelled free of charge up to 24 hours before the scheduled delivery time
• Cancellations within 24 hours of delivery are subject to a cancellation fee of up to 50% of the order value
• Custom/personalised orders cannot be cancelled once production has begun

5.2 Cancellation by Us

• We may cancel orders due to ingredient unavailability, operational constraints, or suspected fraud
• Full refund will be issued for orders cancelled by us

5.3 Refunds

• Approved refunds are processed within 5-7 business days to the original payment method
• Refund timelines depend on your bank/payment provider

6. Product Quality & Complaints

• We use fresh ingredients and maintain strict hygiene standards
• Products are perishable; consume within the recommended timeframe
• Allergen information is provided where possible, but cross-contamination cannot be fully ruled out in a bakery environment
• Quality complaints must be raised within 2 hours of delivery with photographic evidence
• Resolution may include replacement, credit, or refund at our discretion

7. Account & Security

• You are responsible for maintaining the confidentiality of your account credentials
• You must not share your account or allow others to access it
• We reserve the right to suspend or terminate accounts for violations of these Terms
• Notify us immediately of any unauthorized use of your account

8. Intellectual Property

All content on the Platform (text, images, logos, designs, recipes) is owned by or licensed to Le Celebration Patisserie & Cafe and protected by copyright and other intellectual property laws. You may not reproduce, distribute, or create derivative works without our written permission.

9. User Content

By uploading images (cake reference photos, etc.) or providing content to the Platform, you grant us a non-exclusive, royalty-free licence to use that content for the purpose of fulfilling your order and improving our services. You represent that you have the right to share any content you upload.

10. Limitation of Liability

• The Platform is provided "as is" without warranties of any kind
• We are not liable for indirect, incidental, or consequential damages
• Our total liability for any claim shall not exceed the amount paid by you for the specific order in question
• We are not liable for delays or failures caused by events beyond our reasonable control (force majeure)

11. Prohibited Conduct

You agree not to:

• Use the Platform for any unlawful purpose
• Attempt to interfere with or disrupt the Platform's operation
• Place fraudulent orders or provide false information
• Scrape, crawl, or use automated means to access the Platform without permission
• Impersonate another person or entity

12. Modifications

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated date. Continued use of the Platform after changes constitutes acceptance of the revised Terms.

13. Governing Law & Disputes

These Terms are governed by the laws of India. Any disputes arising from or relating to these Terms or your use of the Platform shall be subject to the exclusive jurisdiction of courts in Bangalore, Karnataka, India.

Before initiating legal proceedings, both parties agree to attempt resolution through good-faith negotiation for a period of 30 days.

14. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
